Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Vyrti ("Vyrti," "we," "us"). By accessing or using the Vyrti website, apps, or services (the "Service"), you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 18 years old and able to form a legally binding contract to use Vyrti. By using the Service you represent that you meet these requirements and that any information you provide is accurate.

Vyrti is a barter marketplace that connects users who wish to exchange tangible goods with one another. Vyrti is only a venue. We are not a party to, and have no involvement in, any trade, exchange, communication, or meeting between users.

We do not own, inspect, authenticate, appraise, warehouse, ship, insure, or guarantee any item listed on the Service. Any estimated values shown are informational only and are not appraisals or guarantees of value, authenticity, or condition.

All trades are made directly between users and are conducted entirely at the users' own risk. Items are exchanged "AS IS" and "AS AVAILABLE", with all faults and without warranty of any kind.

You are solely responsible for evaluating the other party, inspecting items before completing a trade, meeting in safe public locations, and complying with all applicable laws (including tax obligations that may arise from bartering).

Vyrti does not offer refunds, returns, reversals, buyer/seller protection, or dispute resolution for trades. Once you hand over an item, the trade is between you and the other user.

You may only list tangible items that you own and have the right to trade. You are solely responsible for the accuracy of your listings. The following may not be listed or traded on Vyrti:

• Services, labor, or intangible goods
• Weapons, firearms, ammunition, or explosives
• Drugs, alcohol, tobacco, vape products, or drug paraphernalia
• Adult or sexually explicit content
• Live animals
• Counterfeit, replica, stolen, or otherwise illegal items
• Recalled or hazardous products

We may remove any listing, restrict, suspend, or terminate any account at any time, at our sole discretion, with or without notice.

You agree not to defraud, mislead, harass, or threaten other users; not to misrepresent items; not to circumvent our moderation systems; and not to use the Service for any unlawful purpose. You are responsible for all activity under your account and for keeping your credentials secure.

If you have a dispute with one or more users, you release Vyrti (and our officers, directors, employees, and agents) from all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes, including without limitation disputes arising from bad trades, misrepresented items, failed exchanges, personal injury, or property damage occurring during meetups.

You agree to indemnify, defend, and hold harmless Vyrti and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of the Service; (b) your listings or trades; (c) your violation of these Terms; (d) your violation of any law or the rights of a third party; or (e) any interaction, meeting, or exchange between you and another user.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. VYRTI DOES NOT WARRANT THAT ANY USER, LISTING, OR ITEM IS LEGITIMATE, ACCURATE, SAFE, OR LAWFUL, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VYRTI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, GOODWILL, DATA, OR PROPERTY, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE OR ANY TRADE BETWEEN USERS. IN NO EVENT SHALL VYRTI'S AGGREGATE LIABILITY EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

Any dispute between you and Vyrti arising from these Terms or the Service shall first be attempted to be resolved informally by contacting us. If unresolved, disputes shall be settled by binding arbitration on an individual basis; you waive any right to participate in class actions. These Terms are governed by the laws of [Governing State/Jurisdiction — to be determined], without regard to conflict-of-law rules.

We may update these Terms from time to time. Material changes will be posted on this page with an updated date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
